Spectrum tenders continue giving rise as many expectations as doubts

Delayed again and again, the ICT Ministry expects to finalize the 700 MHz tender for the fourth quarter. The tender is part of the spectrum plan for 2019-2022. But the new Law of the sector could affect the plans.

The announcement of the 700 MHz and 1900 MHz spectrum tender Action Plan by the Ministry of ICT (MinTIC) updates the promise to allocate spectrum for mobile services, something that Colombia has not done since 2013. Strictly speaking, the document is limited to a short description of the situation and recognizes that "in the second quarter the action plan of the tender process will be published", which will be made available for public consultation.

Only in the third quarter will the draft resolution be published, which will gather the comments of the sector and the accompaniment of the Superintendence of Industry and Commerce (SIC) as well as the Agencia Nacional de Espectro (ANE)(National Spectrum Agency). In the fourth quarter the tender will take place.

Up to that point, the good intentions of the MinTIC. The tender of the 700 MHz band has a history of postponements. On the one hand, the conflict that the Executive maintained with Claro and Movistar stopped the tender for more than six months after both companies had to pay US$1.500 billion in compensation for the reversal of mobile telephony assets, which questioned their participation. To that uncertainty about the role of Telefónica and Claro the criticisms of the operators to the process, expressed in public consultation, such as the distribution of channels and the cleaning of the band were added.

In 2018, the new government of President Iván Duque decided to postpone the project again until the enactment of a new law for the modernization of the ICT sector that proposes, among other things, that the award of spectrum has a term of 20 years instead of 10.

And Mintic itself acknowledges that the law will also allow, for example, to change the collection approach that currently has spectrum award (in accordance with Law 1341 of 2009), by an approach that allows establishing other mechanisms, such as the implementation of Considerations, in the style of the Chilean model, to guarantee coverage in rural areas.

The Cámara Colombiana de Informática y Tecnología (Ccti) (Colombian Chamber of Computing and Technology) and the Asociación Colombiana de Ingenieros (Aceim) (Colombian Association of Engineers) requested that the process be continued independently of the debate on the law so that the process is not postponed. But President Duque says that the ICT modernization bill seeks to "facilitate more investment and regulatory clarity and that Colombia can be in 5G before six years, fully deployed in the national territory", whereby it is believed that law and tenders will not go by separate channels.

The same thing would happen with the actions foreseen in the Spectrum Plan 2019-2022 that the director of the Agencia Nacional del Espectro (ANE) (National Spectrum Agency), Martha Suárez, announced during the presentation of the balance sheet of that agency in session of the Sixth Committee of the Senate. As part of the spectrum allocation policy for the period, the ANE issued a call to award frequencies in the E band (2.5 Ghz). It also opened the process for spectrum allocation in the HF, VHF, UHF and SHF bands. Permits will be granted at the municipal, departmental and national levels, in the HF bands in the range of 3 to 30 MHz, VHF in the range of 30 to 300 MHz, and UHF in the range of 300 to 462.5 MHz, except for the range from 452.5 to 459.4 MHz to fixed and land mobile radio services.
