Telefónica was declared an important provider of Pay TV in 11 regions and must give access to its infrastructure

Board of Directors Resolution No. 00098-2021-CD/OSIPTEL, published yesterday in the Official Gazette El Peruano, declares the Spanish company as an important provider of pay television in the regions of Lima, Callao, Ancash, Junín, Ica, La Libertad, Moquegua, Cusco, Lambayeque, Tacna and Arequipa. For this reason, Telefónica del Perú must grant access and shared use of the telecommunications infrastructure that it uses to provide this service; offer to other providers the commercialization or resale of said service; and inform the regulator about the conditions and discounts applied in the agreements signed.

The measure was announced by Osiptel after an "exhaustive analysis of the cable television market, in which it determined that Telefónica del Peru has a dominant position in the provision of pay television service," the entity said.

Telefónica maintains 63.13% of the market, followed by DirecTV with 19.09% and Claro with 8.89% (Osiptel, March 2021).

The state operator is going through a delicate moment. Its income does not cover operating expenses and it must fulfil a debt obligation of US$110 million. Furthermore, the lack of investments led to the obsolescence of its infrastructure. Oscar Stark, president of the firm, states that alternatives are being evaluated to obtain the necessary funds, including the possibility of adding private partners. And he believes that in 18 months "the situation will be resolved."
