The Superintendence of Telecommunications (Sutel) forwarded to the Constitutional Chamber the speed, which it considers to guarantee the right to information of postpaid users and the operation of the most used mobile applications in Costa Rica. It was in response to the fact that said jurisdiction granted a protective injunction against the fair use policy. The regulator clarified that operators should eliminate the fair use policy immediately, and incorporate data from the contracted service, such as: access speed of the service, agreed data volume and functional access speed.
This speed will be reviewed every two years by the regulatory body. However, the deadline could be shorter if there is a technological change that requires revising the established functional speed. The regulator also clarified that the parameters that determine this functional access will be subject to public consultation.
