In his presentation at CLTD 2025, Carlos Baigorri, president of Brazil’s National Telecommunications Agency (Anatel), announced that the regulator will launch a public consultation in the second half of 2025 to develop a proposal aimed at creating conditions to achieve a balanced solution in the market and thus establish a position on Fair Share.
He recalled that current legislation states that all telecommunications users must use networks appropriately. “We are engaged in a discussion about what ‘appropriate’ means and the role of heavy traffic users,” he said.
In this context, Baigorri emphasized the need for regulators in the region to change their perspective and approach. “We still have a command and control view of regulation: I control you, and if you don’t do what I command, I sanction you. That model is ineffective and costly. Regulation should be based on incentives, that is more effective,” Baigorri explained.
