Anatel to introduce new regulations on sustainable use of resources and orbits

Marcos Estevo, advisor to the Superintendency of Granting and Scarce Resources at the Brazilian regulator Anatel, explained that the agency is preparing a report to create a new regulation for the sustainable use of resources and orbits.

The initiative is the conclusion of a public consultation launched last year, which received 160 contributions on these topics. The goal is for the measures to encourage operators to adopt actions that lead to the sustainable use of resources.

Estevo framed this regulatory initiative within the broader perspective of regulatory adaptation to new space technologies, one milestone of which was the authorization of the operation of exploration satellites in 2021.

Regarding the upcoming ITU World Radiocommunication Conference in 2027, Estevo described the presentation made by Anatel proposing a modification of the technical requirements and frequency allocations to allow earth stations in motion (ESIM) to operate in the frequencies decided at the world conference.

Anatel is also modifying technical requirements for satellite systems. The goal is to give flexibility to those requirements in order to facilitate the emergence of these new systems. “There is a lot of interest among operators,” he noted.

Regarding D2D, he pointed out that Brazil’s approach to the issue is similar to that presented by Chile’s Subtel, where the service is complementary to terrestrial mobile networks and not a substitute.

“Anatel has already approved a new regulatory sandbox to authorize satellite systems to use IMT frequencies for D2D applications,” he explained. The authorizations are not granted to the satellite operator but to the terrestrial mobile operator, who makes agreements with satellite operators.
