Parliamentary initiatives in telemedicine back to try their luck in the 2023 agenda

With the return of the ordinary sessions, the debates on two national bills will be reactivated: one legislates on telehealth and the other includes telemedicine as an ICT service, which would give its providers access to the Universal Service Fund. Another proposal, in the Buenos Aires Legislature, proposes making telemedicine mandatory in public health.

Telehealth tools are applied in day-to-day medical care, protected by the Patient's Rights Law (Law 26,529), the Personal Data Protection Law (Law 25,326, which is currently being updated), the Digital Signature Law (Law 25,506) and the Digital Prescription Law (Law 27,553, not yet regulated). Even the first of these regulations contemplates the Electronic Health Record in article 13 and includes the concept of informed consent. Although these regulatory frameworks are sufficient for the practice of telemedicine, the resumption of ordinary sessions of Congress next March will once again bring two bills up for discussion.
