In the unfair competition lawsuit filed by Wom against Entel, the Supreme Court confirmed that Entel engaged in improper practices by acquiring customers through call centers using false information about its competitors. However, it overturned the Appeals Court ruling that had ordered Entel to pay US$2.4 million to Wom.
The dispute dates back nearly eight years, to a lawsuit filed in February 2018. One year later, the Santiago court dismissed the claim.
Wom took the case to the Appeals Court in 2019. In 2023, that court ruled against Entel, ordering the company to pay US$2.4 million. Entel then appealed to the Supreme Court, which has now ruled in Wom’s favor on the merits but determined that the payment was not warranted.
