Costa Rica seeks to modify its Data Protection Law

There are several initiatives, which have emerged in the last six months that aim to change the regulation. Among the proposals are the strengthening of sanctions, setting a minimum of 15 years to consent to the processing of personal data and restructuring the Prodhab (Agency for the Protection of Inhabitants' Data).

Among the initiatives to modify the Data Protection Law, the work carried out by the deputies of National Liberation, Silvia Hernández and Ana Lucía Delgado, and Mauricio Paris, lawyer and partner of ECIJA Legal Costa Rica, stands out. The three professionals are seeking to amend the Law following the model of the old continent on security of personal information, Convention 108 of the Council of Europe. According to Paris, reaching such a standard could empower the country as a trustworthy place with respect to data security and that foreign companies see Costa Rica as a viable option to carry out business.
